This software and service contract (It is called “Contract“ from below) is that you (It is called ”You“ from below) contract with MOBILEFENCE Inc (It is called ”MobileFence“ from below) and MOBILEFENCE Software & Service (It is called ”Software and Service“ From below). The terms of this condition shall apply to any update, supplement materials, Internet -based services and support on MobileFence which provides for the software unless not coming with any other conditions for this item. If the other conditions are provided, the appropriate terms and conditions will be applied. Before using Software and Service, please read carefully the conditions of this contract. This contract is legal and enforceable contract between you and MobileFence granting licenses. It is agree to the terms of this contract, if you press “Agree” or “Yes”, or use service or install software. Press the button “Cancel” or “No” and do not use this service or install software, if you don’t agree with the terms of this contract. Also, days after purchasing software and service, the way to refund in 3days refers to section 6 of this contract which is shown contact information and (i) contact MobileFence customer service or (ii) contact your service provider how to refund if you bought software and service from service provider. Software and Service (a)sends intercepted internet traffic to MobileFence server for the classification and (b) via the device or online portal, is a user system that is able to access MobileFence account and is an internet control product which is installed on mobile or mobile computing device (It is called “device” from below). Such access and use the software and service follows on more advanced topics of the terms of use agreed to create a MobileFence account by this contract or user. It is designed to monitor E client-server solution traffic and able to limit access to certain content . Client software for the device is distributed on the Internet by MobileFence and other service providers and connected to a server network infrastructure operating as a managed service. 1. Software, service, installation and use. Software and services includes access to a client software and associated Internet services including associated internet service (web site category, a user profile and the usage report which is not limited). a. MobileFence uses the software of the binary version in accordance with the terms and conditions of this contract during the service period set forth below and it is granted to a non-exclusive, non-transferablThis license for you access to software and service. You can install one copy of the software per device in your home and it is called a licensed device per each device. b. You must agree to provide your accurate registration information including your name, address, telephone number and e-mail address to keep up to date on MobileFence during the service period specified below. c. MobileFence is constantly innovating to offer the best experience as possible to users. You agree with the following statement that the form and the characteristic of software and service served by MobileFence can be changed without notice. As part of this continuing innovation, you agree that MobileFence can leave software and service (or function within software and service) off (permanently or temporarily) for you or users according to its own discretion without notice. You can stop using software and service at any time. You do not need to tell MobileFence clearly when you stop using software and service. MobileFence can limit the use of software and service or availability at any time for the performance of maintenance tasks without notice or liability. 2. Terms of Service a. As to free service period of MobileFence software and service, you are provided free of charge for 20 days starting from providing registration information for software and service and then all services are automatically stopped after that. b. As to premium service period of MobileFence, the service lasts until the expiry date of the ticket you have purchased starting from paying for software and service. c. Even though the contents of section above 2(a) and 2(b), If you received software and service as a part of the package solution, the service period is started : (i) software and service or (ii) on other software products or the mobile applications which are included in the package product when you use at the first time or install. d. Even though the contents of section above 2(a) and 2(b), If you received the permission of the software and service from your service provider, the service period is determined by your service provider . If it is not extended to the fixed purchase price, MobileFence premium software and service can be automatically deactivated when MobileFence premium service period or the service period of the package solution is expired or terminated, you can not use MobileFence premium software and service anymore. 3. Internet-based services MobileFence includes Internet-based services as an essential element of software and service. You may not use any kind of software or Internet-based services in a way that can damage software or Internet-based services, such services or interfere with the use of other users. You may not use these services in any way to try to obtain service, data, account or unauthorized access to the network. 4. Scope of License a. Software and service is not sold, but licensed. MobileFence and MobileFence licensor are not limited to have all rights, title and interest, including all intellectual property rights in software and service. You will not acquire any rights as express or implied for software and service except regulations of this contract. Except as expressly provided in this contract, you can not deploy software and service or reassign to license or lease or rent or re-use. You agree with the following statement that it does not have a permission to do reverse engineering, disassembling, de-compiling, in addition to the required range under the law, or (i) invalidating the software protection mechanism, avoid, bypass, remove, deactivate, or incapacitate in different ways, or (ii) the basic concept of software and service, the algorithm, a structure or the source code of the system leading to attempt to derive. b. You may not use software and service to upload, transmit or transfer the data, information, materials or contents to MobileFence or a third party except transfer or assignment of neccessary information for use in its intended purpose. You also agree not to use software and service for illegal or improper purpose. In particular, you agree that you will comply with the local laws that apply to your use of software and service. During the service period permitted details: • For the purpose of backup or archiving, you can make one copy of the software or copies of the software on hard disk of the device, and the original can be kept separately. 5. A comprehensive list of contents monitoring which is collected from data collection and protection software and services are included in MobileFence Privacy Notice. (https://mobilefence.com/privacy.do) In addition, sometimes software and service will be collected the following specific information on the user equipment. • The software will access the device information including IMEI (International Mobile Equipment Identity) for hash creation for guaranteed anonymity. This hash is used to analyze and aggregate the equipment data for statistical purposes. The information above is used in order to identify the communication device that is eligible to receive updates about the software. This information is not used by other personally identifiable information, such as your account information. If the service is terminated, data will be kept in statistical form only for internal research . • Related information of Software installation. This information informs MobileFence whether the software installation is successfully complete, and the product installation success rate of MobileFence will be collected for the purpose of evaluating and improving. This information is not used for personally identifiable information. • Of visited web sites, URL deemed fraudulent in the software and information about the potential security risks. A kind of URL deemed fraudulent in the web site, it may contain personally identifiable information in an attempt to obtain without your permission. This information is collected in order to evaluate and improve the product performance of MobileFence detecting malicious behavior, potentially fraudulent sites, and other Internet security risks. This information is not used for personally identifiable information. • Information about installed applications including the application name and version, the package name, description, and installation/ removal date but which is not limited. • Given name on the device which is installed during the initial setup. Mobile fence will be used this name as the account name for the device only when the user selects an additional service and use a particular software performance. The account name can be changed at any time after software installation (recommended). • IP (Internet protocol) address of installed devices which is installed software used for software operation and license management purpose and / or MAC (Media Access Control) address and system ID. • Other general statistics information is used for product management, analysis and improvement of product features. This information is not used for personally identifiable information. As noted, all collected information is used for provision of the function of MobileFence product or optimization. This information can be sent to MobileFence Group in the United States or in countries which has less stringent data protection laws than countries in which you currently reside (including the European Union), just in this case, MobileFence has taken the necessary action for protection of appropriate level related to the collected information. MobileFence may open to the public the collected information to respond to a subpoena or legal process, or if law enforcement is requested or permitted by law, if necessary. Refund Guarantee within 48 hours. If you are a user who is initially granted copies of this software and license of service, and you are not satisfied for some part of reason, within 48 hours after purchase you can receive a refund through the customer support center or user-support@mobilefence.com 7. Disclaimer Software and service is provided "As it is", "Within the purview". MobileFence and provider include explicit or implied guarantee about marketability, conformity for a particular purpose and non-infringement of intellectual property ownership, but it denies all conditions which are not limited and warranties. To the maximum extent permitted by applicable law, MobileFence and MobileFence provider are not responsible about all kinds of direct damages and consequential damages, special damages, accidential damages, exemplary damages or indirect damages coming about related to This license or a kind of license under any legal theory and case. This is true even if the MobileFence obtained information about the possibility of such damages in the past. You have a duty to manage not to be ROOTING the device applied MobileFence and you can not raise objections about the abnormal operation of MobileFence on routed devices, you must follow the guide line to prevent disabling of MobileFence. You also have a duty to check in advance before buying the paid premium service through the use of the free version of MobileFence being the normal operation. Also, by abnormal operating for the device firmware updating, MobileFence does its best to solve the problem, but MobileFence is no guarantee and does not have any legal responsibility. 2 January 2016
